WEST SACRAMENTO, CA - The 17-year-old subject of a West Sacramento police pursuit Tuesday night in which a pedestrian was hit and killed by a patrol car will not face homicide charges.

The Yolo County District Attorney's Office is charging the teen with felony vehicle theft, felony possession of stolen property, misdemeanor delaying/resisting arrest, misdemeanor evading a police officer and misdemeanor unlicensed driver. He will be tried in juvenile court

Brandon Louis Nickolas, 31, died when he was struck by a West Sacramento police car on West Capitol Avenue between Point Street and Harbor Boulevard. The officer had turned on his car's flashing lights and siren.

Police said Nickolas was wearing dark clothing. The officer involved has been put on paid administration leave pending the California Highway Patrol investigation,
